Affiliate Program Terms
The agreement for people who promote TRNCH for a commission, a fee or free access: what you earn, what you must disclose, what you may say, and how it ends.
Version 1.6 · In effect, last revised 2026-11-03
This document describes what TRNCH does today and applies to every affiliate and paid creator from the day they accept it, and to every payment we make them.
01This agreement
These terms are a contract between you and TRNCH LLC, an Arizona limited liability company (“we” or “us”) about promoting TRNCH: as an affiliate, who earns a commission when people pay through your link; as a creator we pay to make videos or posts; or both. “You” means the person who joins, and the business you join for.
You accept them when you tick the box that says so on the application, or when you accept a written offer from us that names them. Our Terms of Service still apply to your TRNCH account, the Privacy Policy says what we do with your information, and these terms add to both. You must be at least eighteen and able to make a contract, and you must not be in a country under a US embargo or on a US restricted party list.
Your offer
When we take you on, we send you a written offer by email: your link and code, your commission and how long it is paid, the window in which a sign-up counts as yours, how and when we pay you, and, for a paid video or post, what you make, the fee and any usage rights. Your offer and these terms together are the agreement. Where they differ, your offer’s numbers and deliverables win; the rules here on disclosure, honest claims and conduct always apply.
02Applying and joining
Anyone eighteen or older can apply, on the application on our Affiliates page. It asks for your name and email address, the accounts you post on (TikTok, Instagram, YouTube, X, Facebook, a website or another link; at least one), how many people follow you, your niche, and why you would be good.
What you give us must be true
- The accounts are yours, or ones you run with their owner’s permission, and the follower range is real: no bought followers, views or engagement.
- One application per person. Don’t apply for someone else, or again under another name.
- We may look at those accounts, their posts and their audience, ask you to show that you run them, and check the figures you give. Giving us details that are not true breaks these terms.
What happens next
We decide who joins, and we may say no without giving a reason. If we want to go further, we email you to set up a call with our team. If we take you on after it, we send your written offer by email (see “Your offer” above). Applying, and the call, do not make you an affiliate, and nothing is owed to you until we accept you in writing.
We may change or end the program at any time. If we end it, we pay what is owed under “Ending this agreement” below.
03Your link, your code and who counts as yours
- Your link and code are yours alone. Do not sell them, or let anyone else promote with them.
- A customer counts as yours when they open your link (trnch.net/r/ followed by your code) and make a new TRNCH account in the same browser within the window your offer gives (30 days from their click if it gives none), and no other affiliate’s link was opened after yours. A code typed anywhere, at sign-up or at checkout, does not make a customer yours unless your offer says it does. Our records decide, and we will show you what they say.
- Only new customers count. Someone who already had a TRNCH account, or who makes one without opening your link, is not yours.
- No commission comes from your own account, from an account you or someone acting for you made or paid for, or from people you paid or rewarded to sign up, unless your offer says so.
Fraud ends everything
Fake sign-ups, made-up accounts, traffic that is not real people, hidden or forced clicks, setting your link on someone who did not choose it (“cookie stuffing”), and any trick that makes a sign-up look like yours when it is not, are fraud. We keep any commission it touched, end this agreement, and may recover what we already paid for it.
04Commission
Commission is earned only on money we actually receive from a customer who counts as yours, for a plan or for credits, at the rate and for as long as your offer says. It is worked out on what the customer paid after any discount and refund, and before any tax.
- A plan made free by an early access code (Starter and Pro today), a creator account, a tester account’s free days and a free trial bring in nothing, so they earn nothing. When a trial turns into a paid plan, or a customer moves to a paid plan, those payments earn commission like any other.
- Commission on a payment becomes payable 14 days after that payment, once it has not been refunded or disputed. A payment the customer disputes (a chargeback) earns no commission.
- If a payment is refunded or charged back after its commission was paid, that commission comes off what we owe you next.
- We may change your commission for the future under “Changes, law and disputes” below. A change never touches commission already earned.
05Paid videos and posts
When we pay you to make a video or a post, your offer says what you make, where and when you post it, how long it stays up, the fee and any usage rights. We pay the fee within 30 days after you deliver and post it as agreed, unless your offer gives another date.
We pay for your work, never for a good opinion. Say what you really think of TRNCH. We will not ask you to change an opinion, only a fact that is wrong or a disclosure that is missing, and the fee does not depend on what you say about us.
We may ask to see a video before it goes up, so that its facts and its disclosure can be checked. Our look at it takes none of your duties under these terms away from you.
06Your videos: who owns them and how we may use them
You own what you make. You give TRNCH LLC a non-exclusive, worldwide, royalty-free licence to show, share, repost and link to your posts about TRNCH, with credit to you, on our own website and social accounts, for as long as your post stays up. Editing your video, or using it in paid advertising, including running it as an ad from your account or ours, such as TikTok Spark Ads or Meta partnership ads, needs the usage your offer grants, and lasts only as long as your offer says.
Within those uses, you agree we may use your name, handle, image, voice and likeness as they appear in your video, and the words you say in it. If you stop using TRNCH, or no longer hold a view you gave in a post, tell us and we stop new uses of that post.
What goes in your post must be yours to use
- You made it, or you have written permission for anything in it you did not make.
- Everyone who can be seen or heard in it agreed to appear in it.
- Its music is licensed for branded content: on TikTok, a sound from the Commercial Music Library; elsewhere, music you have the rights to. A popular song from a platform’s general library is licensed for personal posts, not for paid ones.
- No one else’s videos, photos or brands, apart from what briefly appears on a TRNCH screen as you use it. Never use a clip you downloaded through TRNCH: our Acceptable Use Policy allows downloads only for studying an ad.
07Always say that we pay you
Disclosure, in every post
In every post, video, story, livestream, comment or link about TRNCH, you must say clearly that you have a connection with us: that we pay you, that you earn a commission through your link or code, or that we gave you free access. This is the law in the United States (Section 5 of the FTC Act, and the FTC’s Endorsement Guides, 16 CFR Part 255), and the rule of every platform you post on. It applies even when the only thing you got from us is a free account.
- In the post itself, where people see it first. In a video, say it out loud and show it on screen, near the start, not only in the caption. In a livestream, repeat it during the stream. In a caption, put it before the “more” cut.
- In plain words: “Ad”, “#ad”, “Paid partnership with TRNCH”, “Sponsored”, “I earn a commission if you sign up with my link”, “TRNCH gave me free access”.
- And the platform’s own label: TikTok’s content disclosure setting for branded content, Instagram’s and Facebook’s Paid partnership label, YouTube’s paid promotion box. The label adds to your words; it does not replace them.
- Not enough on their own: a disclosure only in your bio or on a link page, lost in a crowd of hashtags or hidden after “more”, or words such as “#sp”, “#spon”, “#collab”, “#partner”, “#ambassador” or “thanks TRNCH”.
- A link in your bio that leads to TRNCH needs its own disclosure beside it, such as “Affiliate link: I earn a commission”.
- On a website, blog or newsletter, say it next to your first link to TRNCH or mention of it, before the reader gets there, not only in a footer or on a separate disclosures page.
08What you may say
Only what is true, what you really think, and what you have really found using TRNCH.
- No earnings claims. Do not say or suggest that anyone will make money, a set amount, a living or “passive income”, or quit a job, with TRNCH, and do not show your own sales, revenue or payouts, unless we have approved those exact words in writing first. The FTC treats unproven or untypical earnings claims for money-making tools as deceptive, and adding “results not typical” does not make them lawful.
- TRNCH as it is today. Our figures are estimates we work out from public information, not TikTok’s own data, and they can be wrong: don’t call them exact, official or guaranteed, and don’t promise anyone a “winning product”. Don’t present a feature that is not open yet, such as the Ads Manager, as available.
- Independent. Never say or suggest that TRNCH is made, endorsed or approved by TikTok, Meta, Amazon, Google or Shopify, or use their logos in a way that suggests it.
- Real prices and offers. Use the prices on our pricing page on the day you post. Say “free” only of what is free: a free trial needs a card and then renews at the plan’s price until it is cancelled, and if you mention a trial you must say so too. Early access codes are no longer given out, so don’t offer one.
- No fake reviews or endorsements. Don’t post as a customer you are not, don’t review TRNCH under other names, and don’t buy likes, views, followers or comments for your posts about us (16 CFR Part 465).
- Fair to others. Don’t say anything about a competitor that you can’t prove.
09Where and how you promote
Promote only to adults, from the accounts you gave us or have told us about since, in the places your offer allows. Tell us before you promote TRNCH from another account, so we can see your posts. You may not:
- send email, text messages or mass direct messages about TRNCH unless your offer allows it. Then an email must follow the CAN-SPAM Act (an honest sender and subject line, your postal address and a working unsubscribe, honoured within 10 business days), and a text needs the person’s prior written consent;
- post your link or code as spam in comments, groups or forums;
- bid on “TRNCH”, its misspellings or our domain in search or social ads, or use them in a domain name, an account name or a handle;
- pretend to be TRNCH, our support or an official account, or make a page that looks like ours;
- post your link or code on coupon, deal or cashback sites, or pay or reward people for signing up, unless your offer allows it;
- aim your posts at people under eighteen, or post them on accounts mostly followed by people under eighteen;
- promote TRNCH beside content that is illegal, hateful, sexual or violent, or break the rules of a platform you post on, its branded content rules included.
10We check, and you fix
We look at what affiliates and creators post about TRNCH, because the law expects us to. If we ask you to fix or take down a post (a missing disclosure, a claim that is not true or not allowed here, an offer that has ended), do it within 48 hours. Until it is fixed that post earns nothing, and we may end this agreement over it.
11Your creator account
If we give you a creator account, it is your own TRNCH account under our Terms of Service. It is free while we run the creator program for you, and it ends with this agreement unless we tell you otherwise. It is for you alone: don’t share it, and don’t use it to do research for anyone else.
12Getting paid, and taxes
- We pay in US dollars, through the payout method your offer names and on the schedule it gives. If it gives none, we pay each month for the commission that became payable in the month before.
- Before your first payment we need a tax form: a Form W-9 if you are a US person, or a Form W-8BEN (W-8BEN-E for a business) if you are not. We report payments to the IRS on Form 1099 where the law requires, and if the law makes us withhold tax from a payment (for example because we have no valid taxpayer number for you), we withhold it.
- You are responsible for your own taxes, and for any fee your payout service charges you.
- We may hold a payment while we look into a sign-up or a post we believe breaks these terms, and we will tell you why.
- If you think a payment is wrong, tell us within 90 days of it; after that, it stands.
13Our name and logo
While this agreement lasts you may use the TRNCH name, and the logo files we give you unchanged, only to promote TRNCH as these terms allow. Don’t alter them, combine them with your own marks, or register anything that contains them. Everything else about the name stays ours.
14How we work together
- You are an independent contractor, not our employee, agent or partner. You decide how, when and where you make your posts, within your offer, and you pay your own costs. You cannot sign anything or promise anything for us.
- You may promote other products, competitors included, unless your offer says otherwise.
- Keep to yourself what we tell you that is not public, such as features not yet launched and figures about our business. The terms of your own offer are yours to share.
15Privacy, and the people you refer
The Privacy Policy says what we hold about you as an applicant or an affiliate, and for how long. We never tell you who signed up through you: you see only that a sign-up or a payment came through your link or code, its date and amount, and the commission it earned. Don’t try to find out who they are.
16Ending this agreement
Either of us can end this agreement at any time by email. We can end it straight away if you break it.
When it ends, stop using your link, your code and our name, take TRNCH out of your bio and link pages, and, if we ask, take down posts that break these terms. Posts that follow these terms may stay up, with their disclosures.
Commission on payments we received before the end is paid once it is payable, and so is the fee for a video or post you had already delivered and posted. If we end the agreement for fraud or a serious breach, nothing more is paid for what the fraud or breach touched.
What should outlast the agreement does: the licence for posts already published, for the time it was given; the disclosure in posts that stay up; payment of what is owed; confidentiality; liability and indemnity; and disputes.
17Liability and indemnity
You will defend, indemnify and hold harmless TRNCH LLC and anyone working for it from any claim, fine, penalty, loss or cost (reasonable legal fees included) arising out of your posts, a missing disclosure, a claim you made, your use of anyone else’s work, music, name or face, or your breach of these terms.
The cap
To the fullest extent the law allows, our total liability to you under this agreement is limited to what we paid you, or owe you, under it in the twelve months before the claim, and neither of us is liable to the other for indirect or consequential losses or lost profits. This does not limit the commission and fees you have earned, or your indemnity. We make no promise about how much you will earn.
18Changes, law and disputes
We may change these terms, or your commission for the future, by emailing you at least 15 days before the change starts. Carrying on after that means you accept it; if you don’t, you can end the agreement instead. A change never reduces commission or fees already earned. The version number at the top of this page changes with the terms.
The section “Governing law, arbitration and class action waiver” of our Terms of Service applies to this agreement as if it were written here, including the right to opt out of arbitration within 30 days of first accepting these terms.
19Everything else
- Whole agreement. These terms and your offer are the entire agreement about the program, and replace anything said before about it.
- Signing. Ticking the box on the application, or replying to accept your offer, signs this agreement electronically.
- Notices. Ours to you go to the email address you applied with, or the one you have given us since. Yours to us go to [email protected], or by post to TRNCH LLC, an Arizona limited liability company, 10115 E Bell Rd, Ste 107 PMB 821, Scottsdale, AZ 85260-2189, USA. You can also call us on 480-378-9708, but a notice has to be in writing.
- Assignment. You may not transfer this agreement. We may transfer it to a buyer of the business, on notice to you.
- Severability and waiver. If a court finds part of this unenforceable, that part is trimmed to what is enforceable and the rest stands. Not enforcing something once does not give it up.
