Copyright and DMCA
Public videos play and download through our servers, and the store builder keeps photos and the videos customers upload on them. This is how to complain about any of it, and how we answer.
Version 1.17 · In effect, last revised 2026-10-31
This document describes what TRNCH does today. This version applies from 2026-10-31. What you agreed to before stays on record, and the Refunds page and the Terms say which earlier terms a subscription keeps.
01What we serve, and what we do not
Parts of TRNCH involve somebody else’s material, and we say so plainly:
- Product photographs are loaded from the platform’s own image servers so you can recognise the item, alongside its title, its shop and the figures we calculate.
- Video covers and ad pictures are kept on our servers. A clip’s cover (its still picture) is kept on our servers and in our cloud storage, at full size and as small copies, and the picture of a Meta ad shown by a check as a small copy, so the pages load quickly. A clip taken down here loses its cover too, every copy of it deleted.
- Public videos play through our servers. When you press play on a clip, we fetch that clip from the platform and pass the bytes to your browser. When you press the download button, we save a copy of the video as TikTok plays it, with the creator’s handle in the file’s name and the handle and a link to the original in the file’s details, and hand it to you; if we can’t put them there, you get the file TikTok’s own website gives anyone who saves the video, with TikTok’s watermark and the creator’s handle (we delete our copy 90 days after anyone last asked for it; a later request fetches it again), and we do that only while the creator allows downloads on TikTok, checked at each press. If a customer puts a downloaded clip into an ad with the ads manager’s own button, we keep and send TikTok’s own version of it, with TikTok’s watermark and the creator’s handle. Both exist so an advertiser can study an advert, and anyone who puts a clip into an ad of their own needs the creator’s permission; both are described on the Acceptable Use page, where the rules for what you may do with a downloaded file are set out.
- Words from public reviews and comments. A product’s review checker summary quotes a few of them, and the reviews and comments it was written from can be read beside it.
- The store builder keeps files on our servers. Every store it makes starts with photos from the product’s public listings, and we keep a copy of each, filed under the product, so the next store made from it can use them. Since 14 October 2026 it puts no creator’s video on a store: a store’s videos are ones its owner uploaded, each after confirming that they filmed it or have its creator’s written permission. We keep a record of that confirmation with a fingerprint of the file, and a new copy of the video that we make from it (the file as uploaded is deleted). Stores made before that date started with up to three clips from creators’ public videos of the product, and we kept a copy of those clips under the product; any of them is removed on a proper notice, as below. Photos and videos a customer uploads are kept with their store until they delete it. All of these go into the files the customer downloads for their own Shopify store. What may go on a store is set out in the Terms.
We respect copyright, we expect our customers to, and we act on a proper complaint. If you own a clip and you do not want it served from here, tell us and we will remove it. You don’t need a formal notice for that: write to [email protected] with the link and we stop it playing and downloading through us, within two working days. Turning off downloads on TikTok also stops new downloads of your clip here.
02Designated agent
Send copyright notices here
Copyright notices go to our designated agent: Copyright Agent, TRNCH LLC, 10115 E Bell Rd, Ste 107 PMB 821, Scottsdale, AZ 85260-2189, USA; telephone 480-378-9708; email [email protected].
Our designated agent is registered in the United States Copyright Office’s public directory of DMCA agents (dmca.copyright.gov/osp), registration DMCA-1083050, under TRNCH LLC and the names TRNCH and trnch.net.
03Sending a takedown notice
To be effective under 17 U.S.C. § 512(c)(3), your notice must be in writing and must include all six of these:
- a physical or electronic signature of the copyright owner or someone authorised to act for them;
- identification of the copyrighted work you say has been infringed, or a representative list if there are several;
- identification of the material you want removed and enough information for us to find it. For a clip, the link to the product page in TRNCH and the link to the video on TikTok, which is the link the clip itself carries; for a photo or a clip on a store made with the store builder, the web address of the shop where you saw it and a link to your original, which we use to find the store on our side;
- your name, address, telephone number and email address;
- a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law;
- a statement that the information in the notice is accurate, and, under penalty of perjury, that you are the owner or are authorised to act for them.
A notice missing any of these may not be effective, and we may come back to you for what is missing. Weact within two working days of a complete notice: the material stops being served or downloaded through us, every copy of it on our server is deleted, those in stores made with the store builder included, the store builder never uses it again, and we tell the customer whose page or store it was on, if any.
04Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same agent with all of the following, under 17 U.S.C. § 512(g)(3):
- your physical or electronic signature;
- identification of the material and where it was before it was removed or disabled;
- a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the district where you live (or, if you are outside the United States, for any district where we may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We forward a valid counter-notice to the person who complained. If they do not tell us within 10 to 14 business days that they have filed a court action, we may restore the material.
05Repeat infringers
We terminate, in appropriate circumstances, the accounts of customers who are repeat infringers. Two upheld complaints against one account, about its stores, its ads in the ads manager and clips it downloaded through us and used, together, will normally be the point at which it is closed, and a single serious one can be. Removing a creator’s credit from a file we gave you counts as a serious one. An account closed for this reason is not refunded. This policy is part of our Terms of Service, which every customer agrees to, and we keep a record of each complaint against an account so that we can apply it.
06A warning about false notices
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages, costs and legal fees. Consider whether the use is a fair one before sending a notice, and take advice if you are unsure. So should we.
07Trademark, privacy and other complaints
Trademark
Brand names and shop names appear in the tool only to say which product a figure is about, which is what trademark law allows. If you believe we have gone further than that, write to [email protected] with the mark, the registration and the page.
Your own listing or your own clip
If you are a seller or a creator and you want to know what we hold about your public listing or your public video, or you want it removed, the route is in the Privacy Policy, or just write to [email protected] with the link.
A store made with our store builder
To report one (a fake rating or review, a false claim, or a person’s image used without their permission), write to [email protected] with the store’s web address and what is wrong with it. For your own photo or clip on a store, send a takedown notice as described above.
